Terms and Conditions

PennellChing LLC, doing business as Harbinger Tours (“Harbinger Tours,” “we,” “us,” “our”), is a professional tour operator specializing in luxury tours. We kindly ask that you read the following terms and conditions carefully. These terms, along with our privacy policy, the terms of our suppliers, and any other documents provided by Harbinger Tours to you (“participant,” “you,” “your”), form the complete agreement between us, and both parties agree to abide by these terms. Please note that these terms and conditions include important clauses regarding liability waivers, as well as waivers of class action rights and venue selection and notice requirements. By making any payment (whether by cash, credit card, ACH, wire transfer, or other methods), or by submitting a registration form for any tour, you are unconditionally accepting all terms and conditions outlined in this document. If you are booking on behalf of others or are the account holder, your acceptance applies to all individuals registered under your account. Registration & Payment: Space is limited and registration is complete once the required deposit is made. For registrations received within 90 days of departure, a $100 late fee may apply. Any expenses incurred to expedite documents or information are the passenger’s responsibility. Seats are limited, and the tour will be closed once filled. All rates are in U.S. dollars, per person, double occupancy. If you don’t have a preferred roommate, we’ll make every effort to assign one; however, Harbinger Tours cannot guarantee finding a roommate. If no roommate is available, a single room supplement will apply. The tour price is based on a minimum number of passengers. If this minimum is not met, Harbinger Tours reserves the right to cancel the tour and provide a 100% refund of all paid fees and deposits. The tour price reflects a discount for check payments. Returned checks are subject to banking fees, while payments made via Visa, MasterCard, Discover, PayPal, and American Express incur a non-refundable 3.5% convenience fee.

Tour Accessibility: Our tours often take place in heritage sites that may involve steps, uneven ruins, cobblestone pathways, or other challenging terrains. Guests with limited mobility or difficulty walking may encounter areas that are inaccessible.

Travel Documents: Passports and visas (if required) are not included in the tour price. All travelers need a valid passport for international travel, which must be valid for at least six months beyond the tour’s completion. Entry laws vary depending on your citizenship. You are responsible for ensuring that your travel documents are correct, and any expenses incurred due to document-related issues are your responsibility. Flight tickets must match the name on your passport, and verifying travel documents is the passenger’s responsibility.

Cancellations: If you purchase Travel Insurance cancellation fees can be covered by the travel insurance company provided you get the correct coverage, premium has been paid, and reason for cancellation is insurable. Those who do not purchase insurance should be aware of the following cancellation penalties:

  • Up to 180 days before departure: Full refund minus a $200 handling fee
  • 179–160 days: $1,000 fee
  • 159–120 days: $2,000 fee
  • 119–30 days: 50% of the tour price is forfeited
  • Less than 29 days: Non-refundable

Cancellation penalties are in addition to any applicable airfare or overseas operation fees. Cancellations must be submitted in writing and will take effect upon receipt. Unused portions of the tour cost are non-refundable.

Travel Insurance: We strongly recommend cancellation insurance to provide a full refund in case of illness or unforeseen events. Travel insurance can cover medical expenses, trip interruptions, missed connections, and baggage delays.

Not Included:The tour price excludes travel insurance, excess baggage charges, meals not included in the itinerary, items from the hotel room (mini-bar, telephone calls, laundry), bottled water, alcohol, after-dinner coffee or tea, personal items, U.S. customs fees, or anything not specifically listed as included.

Changes & Late Payments: If you are on a specialized tour, a non-refundable $250 per person may be charged for any changes made to the tour itinerary. Changes within 90 days of departure may not be able to be accommodated. Late payments after the final balance due date will incur a 5% fee based on the outstanding balance. The rate is based on advance purchase excursion rates. All payments made are subject to the terms and conditions, and your deposit confirms your acceptance of these conditions.

Liability & Tour Modifications: Your deposit confirms your tour membership and your acceptance of all your terms and conditions. By accepting your tour membership, you agree that neither Harbinger Tours nor any of its employees or affiliates shall be liable for any strikes, riots, terrorism, wars, epidemics, quarantines, medical conditions, customs regulations, delays, or damages resulting from negligence by any vendor. By embarking on the tour, you voluntarily assume all risks, expected or unexpected, associated with travel. Harbinger Tours reserves the right to refuse any participant before or during the tour and to make changes to the itinerary due to unforeseen circumstances.

Hotel Accommodation & Substitutions: Hotel accommodations are typically arranged for double occupancy unless otherwise specified. Single rooms are subject to availability and incur an additional cost. Room standards may differ from U.S. standards, including differences in bed sizes, room amenities, air-conditioning, and ADA compliance. While Harbinger Tours strives to select 5- star accommodations carefully, we cannot be held responsible for inaccuracies in supplier descriptions or for any hotel substitutions. If necessary, Harbinger Tours may substitute hotels without prior notice, and we cannot be held liable for hotel overbookings. While accommodations may differ from those advertised, they will  meet or exceed the advertised level of luxury and quality.

Guided Tours & Meals: All tours are guided in English by a professional Tour Leader. Meals and beverages are included as specified in the itinerary. Sightseeing experiences and entrance fees are also included as detailed in your tour plan.

Tour Modifications: We reserve the right to alter the itinerary due to unforeseen circumstances such as religious holidays, national celebrations, weather events, or renovations at historic sites. These changes will not be considered a material change and do not constitute grounds for cancellation. We strive to make the trip an absolute delight!

Credit Card & ACH Bookings: By registering for a trip, you authorize Harbinger Tours to charge your card or initiate an electronic transfer. This authorization includes an agreement to the cancellation policy and to the terms and conditions. If you need to dispute a charge, please contact us first. We are committed to resolving any concerns. However, we retain the right to dispute improper chargebacks, particularly those related to non-cancellable reservations or unauthorized charges.
